BreedManager Terms of Service

§ 1. General provisions

1. These Terms govern the use of BreedManager at breedmanager.eu (the “Service”), a web application for managing animal breeding.
2. The Service is provided by Kynologic Sp. z o.o., registered office: ul. Półwiejska 17/26, 61-888 Poznań, Poland, entered in the National Court Register (KRS) under no. 0001066149, tax ID (NIP) 7831890477, REGON 526785413 (the “Provider”).
3. Contact: info@breedmanager.eu or by post to the registered office.
4. These Terms are the terms referred to in Art. 8 of the Polish Act on Providing Services by Electronic Means. Personal data is covered by the Privacy policy and payments by Payments and subscriptions; both form part of these Terms.

§ 2. Definitions

• User — a natural person, legal person or organisation using the Service.
• Consumer — a User who is a natural person concluding a contract not directly related to their business or profession. Consumer provisions also apply to a sole trader for whom the contract is not of a professional nature (Art. 38a of the Polish Consumer Rights Act).
• Account — the User’s individual account in the Service.
• Kennel — the space in the Service where the User (and people they invite) keep their breeding data.
• My animals — the space in the Service for a User who does not run a kennel (the owner of a dog or cat, including a mixed breed), where they and people they invite keep their animals’ data. Provisions of these Terms about the Kennel apply to it accordingly, except for breeding functions (litters, matings, inbreeding coefficient, listings and the kennel page).
• Plan — the scope of features: free (Free) or paid (e.g. Pro, Kennel+), described in Payments and subscriptions.
• User Content — all data, texts, photos and files entered into the Service by the User.

§ 3. Services

1. The Service allows in particular: keeping records of animals, pedigrees, matings, litters, health and weights, calculating the inbreeding coefficient, printing pedigrees, a calendar (including subscription in external calendar apps), reading data from pedigree photos, storing test scans and publishing a kennel page.
2. Printouts and calculations are for guidance only. A pedigree generated in the Service is not a pedigree issued by a kennel club, the FCI or any other organisation and does not replace official documents. The inbreeding coefficient is calculated only from data entered into the Service.
3. The dog show calendar comes from public sources (e.g. ZKwP, FCI) and entry deadlines may be entered by other Users. The Provider does not guarantee their completeness or accuracy — the show organiser’s information is binding.
4. Reading data from pedigree photos is automatic and may contain errors. The User checks the data before saving it.
5. In the My animals space the Service provides free of charge: animal records, health history with e-mail reminders, weights, photos, a calendar and a document folder. For animals without a pedigree (mixed breeds) the pedigree and show results are not available.
6. The “Register the microchip in DogWorldBase” button takes the User to the separate DogWorldBase service (dogworldbase.com), run by the Provider under its own terms; the link carries the animal’s data (microchip number, name, species, sex, breed, colour, date of birth) to fill in the registration form. The registration contract and payment are concluded in DogWorldBase.
7. The Provider may develop and change the Service. A change that restricts the features of a paid Plan during a paid period may not worsen the User’s position without their consent.

§ 4. Technical requirements

A device with internet access, an up-to-date web browser with JavaScript and essential cookies enabled, and an active e-mail address.

§ 5. Account and conclusion of the contract

1. The contract is concluded when the Account is created after accepting these Terms. A contract for the free Plan is concluded for an indefinite period.
2. The User provides true data and keeps the password safe. The Account may not be shared — invite people to the Kennel instead.
3. The User may delete the Account or Kennel at any time in the settings, which terminates the contract, and may first download their data (JSON/CSV export).

§ 6. User Content and the kennel page

1. The User is responsible for User Content and declares that they hold the rights to it (in particular to photos) and that publishing it does not infringe third-party rights or the law.
2. Copyright in User Content remains with the User. The User grants the Provider a non-exclusive, free licence to store, process and display the content as necessary to provide the services — including on the public kennel page or the animal’s public profile (“My animals” space) if the User enables them. The licence ends when the content is deleted, subject to backups kept for a limited time.
3. It is forbidden to post unlawful, offensive or misleading content (e.g. false pedigrees or titles), advertising unrelated to breeding, and animal sale offers that breach animal welfare laws.
4. Anyone may report unlawful content to info@breedmanager.eu. The Provider handles reports without delay and may hide the public kennel page, the animal’s public profile or content pending clarification, informing the User of the reason (in line with Regulation (EU) 2022/2065 — the Digital Services Act).
5. An animal’s microchip number is visible only to people with access to the Kennel and is never published on public pages or pedigree printouts.
6. In the “My animals” space the User may turn on the animal’s public profile at a chosen address (e.g. felican.eu/burek): name, photos marked as public, breed, age, town, description and public journal entries. The profile is off by default and the User can turn it off at any time. The User is responsible for ensuring that the published photos, description and entries do not infringe the rights of others — in particular the image of people shown in the photos. The “Lost” poster is prepared from the data the User enters and is not saved in the Service.

§ 7. Paid Plans

Purchasing paid Plans, renewals, cancellation, invoices and the right of withdrawal are described in Payments and subscriptions.

§ 7a. Listings

Detailed rules are set out in the Listing rules, accepted before publishing each listing.

• In the Pro (up to 3 active) and Kennel+ (unlimited) plans a kennel may publish listings of puppies, kittens, planned litters and animals for sale on the common list at breedmanager.eu. A listing is active for 60 days and can be extended.
• Listings of animals may be published only by kennels registered with a breeding association (e.g. FCI member clubs, FIFe, WCF), giving their affix and membership number. The Provider checks the first listing of each kennel before publication.
• The User is responsible for the listing being true and lawful, in particular under animal welfare law. Listings of animals from puppy farms, without the required identification or documents, and misleading content are forbidden.
• Anyone can report a listing with the “Report this listing” button. The Provider handles reports without undue delay, may hide or remove the listing and informs its author of the reason (Regulation (EU) 2022/2065 — Digital Services Act).
• The Provider is not a party to the contract between the breeder and the buyer, takes no commission and is not liable for performing that contract.

§ 8. Liability

1. The Provider makes every effort to keep the Service available and makes daily backups. Technical breaks may occur; planned ones are announced in advance where possible.
2. Towards Users who are not Consumers, the Provider’s liability is limited to actual damage and to the fees paid by the User in the last 12 months; the limitation does not apply to intentional damage.
3. The Provider is not liable for breeding decisions based on data and calculations in the Service or for the accuracy of data entered by Users or coming from external sources.
4. Liability towards Consumers is governed by mandatory law and is not limited by these Terms.

§ 9. Complaints

1. Complaints may be sent to info@breedmanager.eu or by post; please describe the issue and give your Account e-mail.
2. The Provider replies within 14 days by e-mail or post.
3. Consumers may use out-of-court dispute resolution, e.g. consumer ombudsmen or the Trade Inspection in Poland (uokik.gov.pl), or the consumer bodies of their country of residence.

§ 10. Suspension and termination by the Provider

In the event of a serious or persistent breach of these Terms (e.g. publishing unlawful content despite a warning) the Provider may suspend the Account or terminate the contract with 14 days’ notice, or with immediate effect in flagrant cases, stating the reason. The User receives a pro-rata refund for a paid, unused period unless termination was due to an intentional breach of the law.

§ 11. Changes to the Terms

The Provider may change these Terms for important reasons (changes in law, features or payment methods, security). Users are notified by e-mail and in the Service at least 14 days before the change takes effect. A User who does not accept the change may terminate the contract before that date and receives a pro-rata refund for a paid, unused period.

§ 12. Final provisions

1. Polish law applies. This choice does not deprive Consumers of the protection of mandatory provisions of the law of their country of habitual residence.
2. Disputes with Users who are not Consumers are settled by the court competent for the Provider’s registered office.
3. These Terms are available free of charge in the Service in a form that can be downloaded and printed.
